The Perceptions of U. S. Fashion Industry Professionals` on Fashion Design Copyright Law and Creativity in Fashion Product Development Process

Abstract
This study aimed at examining the U. S. fashion professionals` perception of the effectiveness of Innovative Design Protection Act, the bill introduced to the U. S. congress in 2012, in order to obtain implications to Korean fashion intellectual property protection. For this purpose, nine professionals who are working in the fashion industry in Seattle and vicinity areas were interviewed. Through the interviews, we asked their opinions about the meanings of creativity in fashion product development; the difference between line-to-line copy and interpretation; the ethical issues related to referencing others` design; and their perception of fashion design copyright law. In general, the interviewees considered the activities such as alterating the details or fit of a successful design customized to their target market as a part of creativity in fashion product development. And their perception of fashion copyright issues reflected more economic or practical perspectives rather than ethical perspectives.
